This Take Down Policy outlines the procedures for requesting content removal and provides a framework for handling potentially harmful or illegal material in compliance with relevant laws, particularly the Control of Obscene and Indecent Articles Ordinance (Cap. 390) of the Hong Kong Special Administrative Region (HKSAR).
1. Introduction
We recognize that AI-generated content or user contributions may unintentionally result in offensive, harmful, or inappropriate material. This policy sets forth the process for users to request the removal of such content while ensuring compliance with applicable laws and protecting the rights of all parties involved.
2. Important Notice: Control of Obscene and Indecent Articles Ordinance
Before submitting a Take Down Request, please note:

Preliminary Assessment: All materials submitted will be assessed to determine if they constitute illegal material under the Control of Obscene and Indecent Articles Ordinance (Cap. 390).

Legal Advice: If materials are suspected to violate this ordinance, we may be required to seek legal advice. Such materials may be shared, if necessary, with:

3. Grounds for Take Down
A Take Down Request may be submitted if content on our platforms:

Promotes hatred or discrimination: Any content that incites violence or hatred against individuals or groups based on protected characteristics (e.g., race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, etc.).

Is sexually explicit or exploitative: Content depicting or promoting child sexual abuse material, sexually explicit conduct involving minors, or non-consensual sexual acts.

Is harassing, bullying, or threatening: Content intended to harass, bully, threaten, or intimidate individuals or groups.

Is defamatory or libelous: False and harmful statements about an identifiable individual or group.

Infringes intellectual property rights: Content that violates copyrights, trademarks, or other intellectual property rights.

Is otherwise unlawful or harmful: Any content that violates applicable laws or regulations or is likely to cause harm to individuals or the public.

Causes mental distress: Content that causes significant mental discomfort, even if it does not fit into the above categories, may be submitted for review through the Mental Well-being Fast-Track Process (see Section 12).
4. Submitting a Take Down Request
To submit a Take Down Request, follow these steps:

Physical Address (Required for Copyright/IP Claims): Necessary for legal verification and correspondence.
II. Content Identification

Clear Description (Required): Describe the content you want removed with sufficient detail. Example: “A photo of me wearing a blue dress, posted on March 10, 2024, on the 'Events' page of your website.”

Precise Location (Required): Provide the exact location of the content (e.g., full URL, timestamp, photobook name and page number, or social media post link).

Screenshots/Links (Recommended): Visual evidence that helps verify and locate the content.
III. Reason for Removal

Detailed Explanation (Required): Clearly state why the content violates the Take Down Policy and explain its impact. Example: "This content falsely accuses me of theft, damaging my reputation."

Specific Policy Violation (Required): Reference the relevant section of this policy being violated.
IV. Supporting Evidence

General Evidence (Recommended): Screenshots, documentation, or witness statements to support your claim.

Copyright/IP Claims (Required): Proof of ownership, such as registration certificates or licensing agreements (redacted copies are acceptable).
V. Third-Party Requests

Authorization Documentation (Required): If submitting on someone else’s behalf, provide proof of legal authority (e.g., Power of Attorney, authorization letters, or court orders).
VI. Declaration of Good Faith
By submitting a request, you confirm that the information provided is accurate and complete. Misleading or false information may have legal consequences.
5. Submission Methods
Requests can be submitted digitally or by physical mail:
Method 1: Secure Digital Submission

Encrypted File Transfer: You will receive instructions on securely transferring your request and supporting documentation. Files must be encrypted (e.g., ZIP or PDF format). The password should be sent separately.
Method 2: Physical Mail Submission

Initial Contact: Email vita@gentertainment.ltd to outline your request. Do not include sensitive materials in the email.

Mailing Instructions: You will receive a designated mailing address and instructions for submission. Include a self-addressed, stamped envelope if you need documents returned.

6. Processing Your Request
Upon receiving your submission, G Entertainment will:

Make a Decision: Determine if the content violates this policy.

Take Action: Remove or disable access to violating content within seven (7) business days if applicable.

7. Counter-Notice Procedure
If content is removed in error, you may submit a counter-notice to our Compliance Officer. Include:

A detailed explanation of why the removal was a mistake.

A statement under penalty of perjury affirming your belief.

Consent to jurisdiction in Hong Kong courts.
8. Supporting Mental Well-being
If content causes significant mental distress, you may use the Fast-Track Process:
